PRIVACY POLICY AND PROTECTION OF PERSONAL INFORMATION

This Privacy policy and protection of personal information (hereinafter: « Privacy Policy ») sets forth the practices of the Fédération des chambres de commerce du Québec (hereinafter: « the FCCQ ») for the collection, use or disclosure of personal information as part of its business relationship with you (hereinafter: “the USER”) in the course of the operation of its internet portal dedicated to the promotion of exports between the Province of Quebec and the United States (hereinafter "the COREX Portal").

A. Personal information

The FCCQ collects personal information on a USER in the course of the operation of its COREX Portal:

  • When you complete your registration as COREX Portal USER;
  • When you sign up to our mailing list (newsletter);
  • When you contact the FCCQ, by phone or email for information, complaints or for any other reason.

The personal information we collect in these situations include:

  • Your name
  • Your e-mail address;
  • Your postal address;
  • Your phone number at the office, at home and/or mobile;
  • Your function within your enterprise;
  • Your expertise and your professional interests.

BY REGISTERING TO THE COREX PORTAL THROUGH YOUR SOCIAL NETWORKS ACCOUNT, SUCH AS GOOGLE OR LINKEDIN, YOU MAY PROVIDE TO THIRD PARTIES, DEPENDING OF THE SELECTED OPTIONS, PERSONAL INFORMATION REGARDING YOURSELF OR YOUR CONTACTS ON YOUR NETWORK. YOU AGREE THAT THE FCCQ MAY SHARE WITH THIRD PARTIES THE PERSONAL INFORMATION ABOUT YOU AND APPEARING ON YOUR PUBLIC PROFILE ON THESE SOCIAL NETWORKS.

In general, the FCCQ uses your personal information to:

  • Process and fulfill your registration as a COREX Portal USER;
  • Answer a question or a complaint from your part;
  • Inform you of modifications to our conditions and our policies and/or for other administrative purposes;
  • Protect the security and integrity of the COREX Portal, our organization and our affiliated members.

B. Disclosure to Third Parties

It is the FCCQ's policy not to sell to third parties any personal information about a USER for marketing purposes, unless you specifically authorize us.

As part of your use of COREX Portal, the FCCQ may have to disclose your personal information to: a) government agencies, provincial and federal, which financially support the FCCQ activities; b) certain partners and sponsors c) law enforcement agencies, if the situation so dictates.

The FCCQ reserves the right to disclose your personal information if required by law or if court orders are issued including sending a subpoena or a search warrant. The FCCQ reserves the right to disclose any information it considers necessary in good faith: a) to comply with any legal requirements or judicial proceedings, b) to enforce the COREX Portal End-User Agreement or c) to protect the rights of its other USERS.

For internal purposes, the FCCQ allows only limited access to your personal information and only to employees of certain departments who need to know for the purposes of their duties, such as: the business development service, the Trade Corridors service and the customer service.

It may happen that the FCCQ makes use of external service providers in specific areas and that some of your personal information may be accessed by these providers. In this case, confidentiality measures are taken between the FCCQ and those providers so that your personal information be used in a manner consistent with this Policy and applicable law, rule or regulation.

C. Use of cookies

The FCCQ uses cookie technology (cookies) to help USERS to navigate faster on its COREX Portal.

A cookie is a string of information that is sent by a website and stored on the hard drive or temporarily in the memory of a computer.

The use of cookies is a common practice in the industry and several well-known browsers are initially set to accept them. You can reconfigure your browser to refuse to accept cookies or to alert you when a cookie is installed on your computer. NOTE THAT BY NOT ACCEPTING COOKIES, YOU MAY NOT BE ABLE TO USE CERTAIN FEATURES OF THE COREX PORTAL.

D. Information collected

The FCCQ servers collect and monitor general anonymous information from a USER’s visit on the COREX Portal. The FCCQ collects these statistics to determine the number of daily visitors to our site, the daily requests for a particular file, the types of browsers used by USERS, USER’s domain names and countries of origin. This data helps the FCCQ to personalize its COREX Portal to better meet online needs.

E. Security and storage

All personal information you provide to FCCQ are stored on secure servers with restricted access. IF YOU RESIDE OUTSIDE THE PROVINCE OF QUEBEC IN DECIDING TO VOLUNTARILY SEND US YOUR PERSONAL INFORMATION, YOU AGREE TO THE TRANSFER AND STORAGE OF YOUR PERSONAL DATA ON OUR SERVERS LOCATED IN THE CITY OF MONTREAL, PROVINCE OF QUEBEC, CANADA.

The FCCQ takes reasonable technical means to ensure a safe environment and protecting the privacy of the USERS such as: fire walls, use of antivirus, access management, intrusion detection, redundancy of hosted data, data backup at regular frequency.

HOWEVER, GIVEN THE PUBLIC NATURE OF THE INTERNET NETWORK, USER ACKNOWLEDGES AND AGREES THAT THE SECURITY OF COMMUNICATIONS THROUGH THE INTERNET CANNOT BE GUARANTEED. THEREFORE, THE FCCQ CANNOT GUARANTEE NOR SHALL BEAR ANY LIABILITY FOR ANY BREACH OF CONFIDENTIALITY, PIRACY, VIRUSES, LOSS OR ALTERATION OF DATA TRANSMITTED OVER THE INTERNET.

F. USER’s responsibilities

The USER is not permitted to disclose his password to anyone which must remain confidential. The USER assumes full liability for any loss or damage caused to the FCCQ or to any third parties arising from any activity generated under the password of the USER.

The USER agrees to maintain his personal information should it change or is no longer relevant.

The USER is not permitted to use the communication tools available on the COREX Portal to transmit spam or other material that would violate the COREX Portal End-User Agreement.

G. Retention

The FCCQ uses your personal information only as long as you are registered on the COREX Portal.

At USER’s request or in case of termination of the COREX Portal End-User Agreement, the FCCQ will close your account and delete your personal information.

Despite the closure of your account, we reserve the right to hold for a reasonable period, certain personal information to be in compliance with the law, prevent fraud, collect fees owed, resolve complaints, cooperate with an investigation and any other act permitted by law.

Upon expiry of this period, the residual data files will be destroyed or deleted from the FCCQ’s system.

In the course of the use of COREX Portal, the USER may consult other third party websites via hyperlinks. HOWEVER, THE FCCQ IS NOT RESPONSIBLE FOR THE PRACTICES, ACTS OR POLICIES OF SUCH THIRD PARTIES WITH RESPECT TO THE PROTECTION OF YOUR PERSONAL INFORMATION. We recommend that you carefully read the privacy policy regarding the protection of your personal information in order to determine in an informed manner to what extent you want or not to use their sites regarding their privacy practice.

J. Modification

The FCCQ reserves its right to modify this Privacy Policy and protection of personal information at its discretion. However, any change to this statement will be made in accordance with the laws applicable in the Province of Quebec for the protection of personal information and will be posted on the FCCQ’s website for notification.

K. Governing Law and Jurisdiction

This Privacy Policy and protection of personal information is governed by the laws of the Province of Quebec and the laws of Canada applicable therein and shall be construed in accordance with these laws. You irrevocably consent, that any dispute relating to this Privacy Policy and protection of personal information must be submitted to a competent court in the judicial district of Montreal, Province of Quebec, Canada, to the exclusion of any other possible court or jurisdiction.

This Privacy Policy is subject to all the terms and conditions for the use of the website provided in the online document entitled: COREX PORTAL END-USER AGREEMENT.
